By accessing or using Tommy.app ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Tommy.app.

To use the Service, you must provide a valid email address and create an account. You agree to:

Tommy.app offers the following plans, billed via Stripe:
Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your dashboard — cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods. Trial charges are non-refundable.
We reserve the right to change pricing with 30 days' notice to existing subscribers. Continued use after a price change constitutes acceptance of the new pricing.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these policies without prior notice.
Your content: You retain full ownership of the content you create through your agent — website pages, text, data, and any other materials you produce using the Service.
Our platform: Tommy.app owns all rights to the platform software, branding, infrastructure, templates, and underlying technology. You may not copy, reverse-engineer, or redistribute our platform.
AI-generated content: Content generated by the AI is provided to you under your plan. Ownership and licensing of AI-generated content is subject to the terms of the underlying AI provider (Anthropic).
By using the Service, you grant Tommy.app a limited license to host and serve your content on your subdomain.
By you: You may cancel your subscription at any time via the dashboard or by contacting tom@tommy.app. Your agent and website remain accessible until the end of the billing period.
By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we cease operating the Service. We will provide 30 days' notice for service discontinuation unless required otherwise by law.
Upon termination: Your subdomain and agent data will be retained for 30 days, after which it may be permanently deleted. We are not liable for any loss of data following termination.
The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law:
You agree to indemnify and hold harmless Tommy.app, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sarasota County, Florida.
We may update these Terms at any time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
